Restrictions on rights

Article 23 of the Applied GDPR permits rights to be restricted "when such a restriction respects the essence of the fundamental rights and freedoms and is a necessary and proportionate measure in a democratic society to safeguard..." the particular concern or area.

The restrictions on rights are contained in Regulation 22 and Schedule 9 of the Implementing Regulations 2018 and are summarised in the document below. 

Further guidance on restrictions will be published in due course.  However, the majority of the restrictions replicate the exemptions under the Data Protection Act 2002 and, until new guidance is finalised, reference can be made to the guidance issued under the previous Act, which is published below.
