An Enforcement Notice has been issued to Manx Care due to several fundamental failures to comply with the right of access to personal data in accordance with the data protection legislation.

The right of access to personal data (commonly known as a “subject access request”) is a cornerstone of data protection legislation that has existed in Manx law for more than 35 years. There is no excuse, therefore, for the infringements that have occurred.

The Enforcement Notice imposes an immediate and ongoing requirement on Manx Care to comply with the right of access to personal data in accordance with the data protection legislation.  Failure to comply with the Enforcement Notice may result in a penalty and/or contempt proceedings.
